1. General Overview
These Terms & Conditions (“Agreement”) govern your subscription to the KloudBoy Nextcloud service (“Service”). By subscribing to our services, you agree to be bound by this Agreement.
2. Service Description
The Service provides cloud storage and collaboration tools using Nextcloud. The plan includes the agreed-upon storage and support as detailed in your selected plan.
3. Payment Terms
- Subscription Fees: All fees for the chosen plan are due monthly in advance. Fees are non-refundable unless specified otherwise.
- Setup Fee: A one-time setup fee applies and is payable before account activation.
- Late Payments: Any late payments may incur a penalty, and service may be suspended until full payment is received.
- Additional Fees: Any additional services requested (e.g., extra storage, support upgrades, customization) will be billed separately.
4. User Responsibilities
- Account Security: You are responsible for safeguarding your login credentials and ensuring that all account users comply with this Agreement.
- Data Usage: The Service is subject to fair usage policies. Exceeding the allocated storage may result in additional charges or service limitations.
- Prohibited Activities: You must not use the Service to store, share, or distribute any illegal content, infringe on third-party rights, or engage in malicious activities.
5. Data Privacy & Security
- Data Ownership: You retain ownership of all data stored within your Nextcloud instance. KloudBoy will not access, disclose, or modify your data without your explicit consent, except as required by law.
- Data Backups: Regular backups are not included unless explicitly added to your plan. We recommend subscribing to our Backup & Restore service for additional data protection.
6. Technical Support
- Basic Support: All plans include basic technical support during business hours. For 24/7 support or faster response times, customers may opt for Premium Support at an additional fee.
- Annual Maintenance Contract (AMC): It is recommended to subscribe to our AMC for regular updates, patches, and system optimization. The AMC is billed annually.
7. Service Level Agreement (SLA) more
- Uptime: We strive to maintain 99.9% service availability. Downtime due to scheduled maintenance will be announced in advance.
- Incident Response: Support requests are handled according to the level of support in your plan. Premium Support customers receive prioritized service.
8. Service Modifications & Termination
- Modifications: We reserve the right to modify the Service, including pricing, features, and policies, at any time. You will be notified of any changes in advance.
- Termination by Client: You may terminate the Service at any time by providing 30 days’ written notice. No refunds will be issued for unused portions of prepaid fees.
- Termination by KloudBoy: We may suspend or terminate your account if you breach this Agreement, including failure to make timely payments or misuse of the Service.
9. Limitation of Liability
- No Liability for Data Loss: KloudBoy is not responsible for any loss of data unless you have subscribed to our Backup & Restore services.
- No Warranty: The Service is provided “as is” without any warranties, express or implied. KloudBoy does not guarantee that the Service will be error-free or uninterrupted.
- Limitations: KloudBoy’s liability for any claims related to the Service is limited to the amount you paid in the last 6 months of service.
10. Data Compliance
- GDPR Compliance: KloudBoy follows data protection regulations (such as GDPR) to safeguard personal data.
- Client Responsibility: You are responsible for ensuring that your use of the Service complies with applicable data protection regulations.
11. Amendments to the Agreement
KloudBoy reserves the right to amend this Agreement at any time. Clients will be notified of significant changes via email. Continued use of the Service constitutes acceptance of the amended terms.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of High Court of Kerala. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts in India.
